      CORK BOYS DEATH

      Evidence At Inquest.

      at the North Infirmary yesterday evening an inquest was held by Mr. Coroner James J. McCabe, solr., into the circumstances connected with the death of a boy named Daniel Collins, 8 ? years, of 7 Emmet Place, who was knocked down by a motor car on Saturday evening and killed.

      Superintendent Mansfield represented the Civic Guards.

      Mr. M. Dorgan, soir., appeared for the driver of the motor car, Patrick O'Brien, Woodlands, Glanmire.

      A jury of which Mr. Michael Ormond was foreman having being sworn, and the body viewed, evidence was taken.

      MOTHER'S EVIDENCE.

      Mary Anne Collins, mother of the boy, gave evidence of identification. She last saw him alive on Saturday evening, the 28th March. He then came in for a little ball, which he took with him into the street. She next saw him ten minutes after, when he was put into her arms dead. He was 8 ? years old.

      Replying to Mr. Dorgan, solr., witness said that she knew the driver of the car, and she had no blame. to Patrick O'Brien.

      Dr. Mary Galvin, M.B., House Surgeon North Infirmary, stated that on the evening of the 28th March, about 6 o'clock, she was called to the accident room in the hospital to see a child whom she was told had been in a motor accident. She examined the child, and found he was dead. His skull was badly crushed. The cause of death was shock and laceration of the brain. Such an accident could be caused by the impact of a motor car. The child had not been long dead.

      John Stokes, a youth, was then called.

      Coroner-Do you know the nature, of an oath ? No answer.

      Do you know what would happen to you if you told a lie? Yes. What would happen you? I would be put into gaol (laughter).

      Giving his evidence, he said he was playing with the deceased on Saturday evening. They were playing hurley by the Opera House. Witness saw a motor car coming around by Booth and Fox's corner. The deceased was running across the road when the motor car approached. The deceased was following the ball, and his cap had fallen off. The motor car knocked him down as he was picking up his cap. The whole of the motor car had passed over the deceased. The car was going at a good speed, and was very near the footpath at Booth and Fox's side. The driver had pulled up and went over to the deceased. Witness ran over and found young Collins, lying near the footpath at Mr Charles McCarthy's side. The front and back wheels of the motor car had passed over the deceased. It has pulled up after going a small bit.

      To a juror - The driver did his best to avoid an accident.

      Examined by Mr Dorgan - When witness had seen the car it was by Booth and Fox's corner. He could not say if the driver (O"Brien) could have seen the deceased when the accident happened. The driver was on his left hand side. The accident occurred just facing Mr Charles McCarthy's shop.

      Were you often cautioned against playing hurley on the street? Yes.

      Cecelia Humphreys, 2 Emmetts Place, gave evidence that on the evening in question she was going home through Academy street she she saw the body of the deceased on the ground. The motor car was standing a bot down from the deceased. She saw the driver jump off the car and pick up the body. The car was a little bit up from the body.

      Patrick Hassett, motor engineer, employed at Johnson and Perrott's, stated that he heard the cry that a child had been killed. Witness rushed to where the motor car was. It was stationary, and was facing towards, the garage. It was well inside its own side of the road and about five or six feet from the footpath. The child was lying between the hind wheel and the end of the car. about five minutes to five o'clock on the evening of the accident the driver, Patrick O'Brien called to Johnson and Perrott's garage for a car the had beeb undergoing repairs. O'Brien took the car out to test it about 5.30. O'Brien had only a few minutes in the car when the accident occurred. He then described the position of the car.

      DRIVER EXAMINED

      Answering Mr Dorgan, solicitor - O'Brien was a most careful experienced driver.

      Patrick O'Brien, the driver of the motor car, having been cautioned by the Coroner, elected to give evidence. He took the car out, he said, and went down Half Moon street and came around the Opera House. When he came into Emmett Place he went for the left side of the road, about four of five feet from the footpath. He saw children playing on the footpath opposite Mr Charles McCarthy's premises. They were playing ball. As witness was passing the deceased rushed out, running across the front wheel of the car and this passed over him. When he saw the child he swerved to the right to avoid an accident . He was at the time in the act of pulling up the ca, which was then going at three miles an hour. The car had only proceeded a few feet when it stopped. It had gone its own length. Witness did all he could to avert the accident. He was a friend of the boys mother fro years. Witness was 19 years a driver and had had world wide experience driving. He never before had an accident.

      To Supt. Mansfield - A six cyclinder Buick car was a high power car. It was possible to drive this car at tip gear at three miles and hour and to stop it at that.

      This closed the evidence, and

      Mr Dorgan, solicitor, on behalf of the driver, expressed his regret for the accident. The driver was a man who had vast experience and was a careful man. Hurling on the street was a most dangerous practice and the authorities were doing their best to stop it. He suggested that the jury could not place too much reliance on the evidence of the children who had been examined, as to the position of the car, and submitted that the driver had done all that was possible to do to avoid the accident.

      A DANGEROUS PASTIME

      The Coroner agreed with Mr Dorgan as to the danger of children hurling in the public streets, and having reviewed the evidence, he said that the unfortunate accident was attributable to this extremely dangerous habit of ball playing on public thoroughfares. From the facts presented in the evidence he did not see how any blame could be attachable to the driver who did everything he could to avoid the accident.

      The jury found the the death was due to shock and laceration of the brain, the result of an accident, and expressed sympathy with he parents of the boy.
