      SHOOTING SEQUEL

      Alleged Attempted Murder

      At Mallow District Court yesterday, before Mr. W. P. Cahill, a young man named Maurice Ford, Millfield Cottages, Blackpool, was charged on remand with having on the 27th April, 1922, at Greenhill, Mourneabbey, feloniously attempted to murder by shooting Maurice O'Connell, of Dublin street, Blackpool.

      Mr. D. Casey, State Solicitor, prosecuted, and Mr. Barry Sullivan, solr., Mallow, appeared for the defence.

      Detective Stapleton proved to the accuracy of a deposition he had previously made. It related to the arrest of the accused, who surrendered himself at Moore's Hotel. When charged the accused said, *'I will say nothing."

      MAURICE O'CONNELL'S EVIDENCE.

      Maurice O'Connell was then called, and stated that he was a coach-builder by trade. He resided at 9, Dublin street. Blackpool, Cork. About five years ago he married a Miss Margaret O'Riordan, the owner of the house mentioned. Her two brothers were then living with her.

      After the marriage witness went to the house to reside with her.

      During the Anglo-Irish trouble the house was frequently used as a hiding-place by members of the I.R.A. who were on the run. Tho accused was one of the I.R.A. men.

      When the Truce was signed all the I.R.A. men left, except the accused.

      Accused resided in Blackpool, about 100 yards from witness's house. He was a married man, and his wife and children were living in Millfield. His wife had since died.

      Shortly after the Truce witness asked the accused to leave his (witness's) house, but he declined to do so. Later on, in consequence of something between the accused and witness's wife, which witness considered suspicions, and in consequences of certain information witness received, he asked the accused to again leave, and he refused.

      From the Truce period the accused remained constantly in witness's house.

      On the 23rd April, 1922, witness left his home taking one child with him to reside with his father at Greenhill, Mourneabbey.

      When witness left his home, his wife and another child remained at home in the house.

      Witness left his home in Blackpool because he could not "stick" the presence of the accused, by whom he was upset.

      On the 27th April, 2922, about 4 o'clock that evening witness was in the kitchen of his father's house. Some strangers came in. The accused, Jerh. O'Riordan, witness's brother-in-law, witness's father, his sister, his mother, his child, and himself were there.

      Accused and O'Riordan came in by the back door. Accused came to witness and demanded the child from him in a threatening attitude. Witness refused to hand over the child, and accused said he would take the child by force.

      Witness said if he took the child he would take it over witness's dead body. The accused muttered some words which witness could not catch. Accused and O'Rrordan then left the house by the front door. Witness followed them out on to the road to see how they had come and who was with them.

      They were standing just by the gate of the house. Witness saw a motor car within about 50 yards of the house, and a driver, whom witness knew to be Thomas Shaw, of Thomas Davis street, Cork.

      Witness stood near the accused and O'Riordan on the road, and accused moved backwards about two yards. O'Riordan was the nearest to witness. Accused's hands were in his coat pocket. Witness's side was turned to the accused. Witness then found a sting on his right ear, going into his head behind the ear, and he knew he was shot.

      He did not remember any more until seven or eight days afterwards, when be recovered consciousness in the Cork South Infirmary. Witness was in the infirmary for ten weeks.

      After a fortnight he was ordered back to the infirmary to be operated on. Witness was in and out to the infirmary for periods. There were six operations performed on him.

      On several occasions between the Truce and the 27th of April, 1922. the accused had threatened him sometimes with a revolver and sometimes without a revolver. The accused had taken complete control of witness's house. During the period mentioned witness saw a revolver with the accused on two or three different occasions.

      A month before the date in question the accused assaulted him in his witness's house for having ordered him to leave. Witness was injured on the occasion and was treated by Dr. O'Brien, Cork. Witness's wife was present at the assault.

      After the assault witness went to the Rev Fr. O'Flynn, Cathedral, Cork, and made a complaint to him. While with the Rev Fr. O'FIynn in a room at the presbytery the clergyman opened the door, found the accused outside and brought him into the room.

      Fr. O'FIynn then repeated the charges witness had made against the accused. Accused got indignant and Fr. O'FIynn had to force him out of the room. Fr. O'FIynn on that occasion had asked the accused to leave witness's house. On the same evening Fr. O'FIynn visited witness's house.

      After that the accused came to the kitchen to witness. He said he was leaving for six months, but would then come back when witness would be out of it.

      Accused went out, but came back the following day. That would be about 23rd April, 1922.

      On the date on which witness was shot he saw no firearms with the accused or O'Riordan.

      THE' CROSS-EXAMINATION.

      Cross-examined by Mr. Barry Sullivan-I am not aware that after the injury the accused surrendered himself to the I.R.A. headquarters at Union Quay, Cork. There were criminal proceedings taken by the I.R.A. against the accused.

      When the case was over and finished, witness had heard of it.

      Witness did not appear at the trial.

      He did not get any notification of the trial, and if he had got it he would not attend the trial.

      Witness wrote no letter to the court stating that the injury was an accident.

      Witness, looking at a report (produced) of the proceedings, which stated that a letter had been received by the court from the wounded man stating the shooting was all an accident, and that the accused should be released, and the accused was accordingly released from custody, said he wrote a letter at Shaw's request, under duress, stating that the shooting was an accident. Shaw called for this letter, and witness gave it to him.

      Shaw said to witness to give him a few lines to get the accused out. Shaw said he came under duress.

      Witness knew accused was in gaol and was going to be tried. It was not witness's desire to pet him out of gaol.

      He was not for months before the injury on friendly terms with accused.

      Witness had been told that the accused immediately after the injury went a considerable distance for a priest and a doctor for witness.

      Witness did not pay a friendly visit to the accused after coming out of the South Infirmary, but his wife did, and witness was with her.

      Witness's wife was in a covered car and he was also in the car.

      Witness did pay the visit, but he did not know where he was going at the time.

      Accused came out from the Bridewell to the cover car though he was a prisoner. There were no hostile words between witness and the accused.

      Other evidence having been heard, the further hearing of the case was adjourned Tuesday fortnight, the accused being admitted to continuing baiL

      ATTEMPTED MURDER CHARGE

      ¹900 Compensation Sequel

      STRANGE CASE HEARD AT MALLOW.

      At Mallow District Court yesterday, Mr. W. P. Cahill presiding, further evidence was taken in the case in which a young man named Maurice Forde, Millfield Cottages, Blackpool, was charged with having on the 27th April, 1922, at Greenhill, Mourneabbey, feloniously attempted to murder by shooting Maurice O'Connell, of Dublin street, Blackpool.
      Supt. McGann prosecuted, and the accused was represented by Mr. Barry Sullivan, solr., Mallow.

      ¹900 COMPENSATION.

      At the request of Mr. Barry Sullivan, Maurice O'Connell, the chief witness for the prosecution, was recalled, and replying to questions said that he did not remember having dictated a statement to any patient while he was in the infirmary respecting the accused.
      He (witness) made a claim for compensation before the Recorder in October, 1922, and got ¹900 for malicious injury.
      He did not state to the Recorder that his brother-in-law, Riordan, and Shaw, the car-driver, were with the accused at the time of the occurrence. He was not asked the question.
      The evidence he was giving that day did not differ from the evidence he gave before the Recorder,
      He did not deliberately conceal Shaw's evidence when he (witness) was before the Recorder.
      He proved the malicious attack made upon him by a previous assault committed by the accused in him. Since the last court day witness had made arrangements to go to America.
      This closed the case for the prosecution, and Mr. Barry Sullivan, for the defence, submitted that there was no malicious motive, and that the shooting was purely accidental.

      ACCUSED EXAMINED.

      Maurice Forde, the accused, who said he resided at Millfield Cottages, Cork, in the course of his examination by Mr Barry Sullivan, stated there was no truth in the accusation that be deliberately attempted to murder Maurice O'Connell, and neither was there any foundation that any undue relations existed between him and O'Connell's wife.

      In April, 1922, witness was a first lieutenant in E. Company I.R.A., Blackpool area.

      He had gone to Greenhill, Mourneabbey, on the evening of the occurrence at the invitation of O'Connell's brother-in-law, Riordan, who was taking a letter to O'Connoll from a firm of coachbuilders at Edenderry.

      O'Connell was a coachmaker, and the letter was about a job for which O'Connell was looking.

      Witness had not been without a revolver for four years previous to that date. "When he got to Greenhill he believed his revolver was "cocked," but he was not aware of it.

      Riordan went into O'Connell's house first, and after three or four minutes he returned to witness and said, "Come in. Maurice has sent me out for you." Witness refused, to go in because there were strangers there.

      He looked up the road and saw Maurice O'Connell standing on the road. He went up to him, and the three, of them then entered the house together.

      They had a friendly conversation there for about twenty or twenty-five minutes, and before leaving O'Connell said to them, "Can't ye have a cup of tea before ye leave?" They declined, saying Shaw, the driver of the car, was in a hurry, as he had a youngster with him who was only after putting a fit of measles over him.

      They then left the house, O'Connell following to see them off.

      Witness was wearing a heavy pilot coat, and when they got on the car witness put his hand in his coatpocket for his gloves. He found that the revolver was lying on the gloves.

      He took the revolver out with his right hand, with his four fingers around the trigger guard. He turned the barrel skywards, and while changing the revolver from one hand to the other he heard an explosion and saw O'Connell fall.

      Witness was greatly surprised, as he did not even feel the kick of the revolver in his hand.

      Witness then knelt down beside O'Connell to see if anything had really occurred to him, and he was shocked to see blood oozing from his ear.

      Witness was very much distressed and went for a priest and doctor on Shaw's car. He did not know the country and was misdirected on the road. He was informed by a man breaking stones on the road to go to Grenagh, where he would get a priest.

      He saw the priest, to whom he said-"I am after shooting- a man accidentally, and come with me quickly." The priest upraided him for having a revolver at all, and said the occurrence was outside the parish.

      Witness returned with Shaw on tho car, and he said to Shaw, "For goodness sake, drive me to Union Quay," whore witness surrendered himself.

      He was present in the Republican Court when a letter was read from the accused describing the occurrence as an accident and he was discharged.

      When O'Connell came out of hospital he said to witness-"Maurice, I have not a word of blame to you." That, was said at the bridewell, where witness was a prisoner.

      O'Connell said. "Why are they keeping you here? Sure I have made a statement that it was an accident." They shook hands and parted friends.

      When witness learned from a notice in the Press of compensation he went to the late Mr Donal Galvin, solr., and consulted him with regard to his position in connection with O'Connell's claim for malicious injury. Mr Galvin informed him that it did not affect witness, as he had already been acquitted. He also went to Mr Maurice O'Connor, solr.. stating that he was fully prepared to give evidence in connection with O'Connell's application for compensation.

      Jerh. Riordan. 9, Dublin-street, Blackpool, corroborated. He was satisfied it was accidental shooting.

      This closed the evidence, and Mr Barry Sullivan, having contrasted the evidence on both sides, submitted that the accused was entitled to be discharged. There was no malicious motive. The accused and O'Connell had been on friendly terms, and the shooting was altogether accidental.

      The Justice having reviewed the evidence, remarked that it was a most extraordinary case and each time it came before him it took a different turn. There was no evidence of threats having been used, and taking the evidence as presented to him he did not believe that the accused had gone out on the occasion with Riordan to shoot O'Connell.

      He did not think any jury would find the accused guilty of the charge set out by the prosecution, and he accordingly refused informations and ordered the accused to be discharged.

      Accused then left court.

Association), beloved husband of May Forde, 55 Dublin Street. Deeply mourned R.I.P. Removal on this (Saturday) evening at 7 p.m. to the Church of the Annunciation Blackpool. Requiem Mass at 10 a.m. on tomorrow (Sunday) will be offered for the repose of his soul. Funeral immediately afterwards to Rathcooney Cemetery.
